Fighting For Maximum Personal Injury Compensation
There are two types of compensation that an injury victim can seek: economic and non-economic damage. The amount of these damages will be based on the specific information relating to your case. The following list contains the compensation that Rosengard Law Group may seek on your behalf.
Lost Wages and Benefits
This type of compensation covers all past, current, and future lost wages and benefits that you have experienced as a result of the injury.
If you cannot return to work, your compensation package will include all future earnings. Included in this part of the economic damages will be any benefits that you may also lose or have lost as a result of not being able to work.
These benefits may include retirement contributions, health insurance premiums, and profit sharing.
We will fight to recover all medical bills that are a result of the injury including future medical bills for treatment, therapy, and long-term care.
Rosengard Law Group will work closely with your medical care provider to come up with a realistic cost for your medical treatment now and in the future.
Your accident may have resulted in loss of personal property, cost for medical supplies, transportation costs to medical care providers, loss of a vehicle as part of a car accident, or similar expenses you have incurred.
Pain And Suffering
Pain and suffering is a non-economic damage that your attorney will include in your compensation package. This amount will be different in each case because every accident has unique circumstances and injuries.
Rosengard Law Group will use medical records and other evidence to determine how deeply these injuries have impacted your life and fight for maximum compensation.
Emotional duress is much like pain and suffering. We may decide it’s wise to have you evaluated by a therapist to see how you are handling the case emotionally.
Loss Of Consortium Or Companionship
If your injuries cause your relationship to suffer, we may file a compensation case for both you and your spouse for loss of consortium.
Punitive damages may be awarded in a personal injury case if the court believes that the injury was caused intentionally, maliciously, or due to a very reckless act. Punitive damages are meant to punish the person responsible for the accident.
You may be entitled to one or more of the above forms of compensation or additional forms not stated in this list. Rosengard Law group will go over the facts of your case and uncover every bit of compensation you are entitled to under the law.
That Personal Injury Cases Follow
The legal process will follow similar steps regardless of the type of injury you’re suffering. Understanding how these steps work will allow you to move through this process with confidence.
1. Initial Consultation
You will meet with us and discuss the facts of the case. We’ll ask many questions about the event and your injuries. If at this time we believe you have the right to seek compensation, we’ll provide you with a retainer agreement for our services. (YOU PAY ZERO UPFRONT FEES. WE ONLY COLLECT A PERCENTAGE OF THE SETTLEMENT WHEN WE WIN YOUR CASE.)
2. Discovery Process – Part One
During this phase, we’ll begin gathering information about your case. This will include information about the accident, your medical records, and employment records to show us what types of losses you have suffered as a result of the accident.
We will present our findings to the insurance company covering the accident, and submit a request for settlement. The insurance company can negotiate this offer or decline it in full.
We will try to get the insurance company to honor its policies, and pay a full compensation package for your losses. In some instances, an agreement can be reached, and the case will settle.
If the insurance company will not agree to a fair settlement, we will file a lawsuit.
4. File a Lawsuit
If we feel that the insurance company is being unreasonable, we will take the case to the next step, file a lawsuit against the insurer.
5. Discovery – Part Two
Once a lawsuit is filed, the attorneys for both sides of the case will begin aggressively gathering information to build their cases. This part of the process may require depositions (interviews), secondary medical opinions, and bringing in medical experts.
6. Settlement or Trial
The insurance company has the option to settle the case right up until the time the trial begins. If they do not settle, your attorney will represent your case before the judge and jury. Once the case is presented by both sides, the jury will determine the outcome of the case, and the judge will verify their decision.
